Terms and Conditions

Notice: This is a non-binding translation of the Terms and Conditions. In the event of any legal disputes, the original Czech version is the only legally binding document.

TERMS AND CONDITIONS
 
I. Basic Provisions
  1. These General Terms and Conditions (hereinafter "Terms and Conditions") are issued pursuant to Section 1751 et seq. of Act No. 89/2012 Coll., the Civil Code (hereinafter "Civil Code").

  1. These Terms and Conditions govern the mutual rights and obligations of the Seller and a natural person who concludes a purchase contract outside their business activity as a consumer, or within their business activity (hereinafter: "Buyer") through the web interface located on the website available at www.plodyzeme.cz (hereinafter "Online Store").
  2. Provisions of the Terms and Conditions are an integral part of the purchase contract. Deviating arrangements in the purchase contract take precedence over the provisions of these Terms and Conditions.
  3. These Terms and Conditions and the purchase contract are concluded in the Czech language.

II. Information on Goods and Prices

  1. Information about goods, including prices and main characteristics, is provided for individual items in the catalog. Prices include VAT and all related fees. Prices remain valid as long as they are displayed in the online store.
  2. The presentation of goods is informative; the Seller is not obliged to conclude a purchase contract for these goods.
  3. Shipping and packaging costs are listed in the online store and apply only within the Czech Republic.

III. Ordering and Conclusion of the Purchase Contract

  1. Costs for remote communication (internet, phone) are borne by the Buyer.
  2. Orders can be placed via a customer account or without registration.
  3. Before sending the order, the Buyer can check and change data. The order is sent by clicking "Order with obligation to pay".
  4. The Seller will confirm receipt of the order by email. The contract is concluded only when the Seller accepts the order (Acceptance notice).

IV. Customer Account

  1. Buyers must provide correct data and update it if it changes. Access is protected by a username and password.

V. Payment Terms and Delivery

  1. Payment methods: bank transfer, credit card, cash on delivery, or in person at the store/pickup point.
  2. The Buyer acquires ownership only after full payment and takeover of the goods.

VI. Withdrawal from the Contract

  1. A consumer has the right to withdraw within 14 days of receipt of the goods.
  2. Exceptions for withdrawal include perishable goods or goods in sealed packaging opened by the Buyer (hygiene reasons).
  3. Refunds include shipping costs (at the rate of the cheapest offered method).

VII. Rights from Defective Performance (Warranty)

  1. The Seller is responsible for the goods having no defects upon receipt and being fit for purpose.
  2. Complaints must be processed within 30 days.

IX. Out-of-Court Dispute Resolution

  1. The Czech Trade Inspection (ČOI) is the competent body for out-of-court settlements (https://adr.coi.cz/cs).
